Vendor Agreement
When engaging in work with Another Muse Photography and downloading my gallery, I confirm that I've understood the following responsibilities and terms:
1. DELIVERABLES & GALLERY DOWNLOAD. The photographer agrees to deliver edited, high-resolution images to the Vendor within approximately three weeks of the session. Images will be shared via Pixieset, an online gallery platform, where Vendors may download their selected images. The gallery will remain active for up to 20 days. It is the vendor’s responsibility to download all desired images before the gallery expires. While unlikely, the Photographer cannot guarantee continued access to the gallery or availability of the images after this period. Although unlikely, the photographer may delay delivery due to workload, emergencies, publication restrictions, or circumstances beyond reasonable control.
2. CREATIVE CONTROL: The photographer retains the creative discretion regarding composition, lighting, posing, editing, image selection and final delivery. The Photographer is not required to deliver every image captured during the session.
3. EDITING. Images shouldn't be altered or edited without the photographer's consent, as the editing style is part of the artistic work.
4. COPYRIGHT. The Photographer retains full copyright ownership of all images created during the session. The Photographer may use the images for portfolio display, website content, social media, publication submissions, marketing, advertising, and other promotional purposes.
5. LICENSE AND USE. The photographer grants vendors a non-exclusive, non-transferable license to use the delivered images for the vendor's own website, social media, portfolio, advertising and marketing purposes. The vendor may not sell the images, sublicense or transfer the images to third parties, submit images for publication without the photographer's permission, or alter the images beyond minor cropping/resizing. The use of filters, presets, AI editing tools, excessive retouching, or modifications that substantially alter the photographer's work is not allowed without prior written consent.
6. CREDITING. When sharing or publishing any photography online or in printed materials, the vendor shall credit the photographer. If the images are shared by a third party (e.g. a printed or online magazine), the vendor shall ensure that the photographer is credited. For social media post, please credit in the caption, 'Photography by @anothermusephotography' and tag. For website, please credit by mentioning 'Photography by Another Muse Photography', linking to the photographer's website.
7. LIMITATION OF LIABILITY: The Photographer shall not be held liable for any loss, damage, delay, injury, or failure to perform resulting from circumstances beyond reasonable control, including equipment malfunction, technical failure, or third-party actions, except in cases of wilful misconduct or gross negligence. In no event shall the Photographer be liable for indirect, incidental, consequential, or financial damages, including loss of profit, business, or data. All participants are responsible for their own personal property and safety during the session.
Model Release
The model grants Another Muse Photography and all participating vendors involved in the session permission to photograph and record their likeness, appearance, voice, poses, expressions, clothing and overall participation during the session.
The Model acknowledges and agrees that:
- The resulting images and recordings may be used by the Photographer for portfolio, editorial, promotional, educational, advertising, marketing, website, social media, publication submission, and commercial purposes without further approval or compensation.
- The Photographer retains full copyright ownership of all images;
- The Photographer retains full creative discretion regarding posing, composition, lighting, editing, image selection, and final delivery
- Images will be edited in the Photographer’s artistic style
- Participating vendors may use the delivered images in accordance with the licensing and crediting terms outlined in this agreement; images may appear in print and digital formats, including websites, blogs, social media, magazines, advertising campaigns, and promotional materials
- The Photographer is not obligated to provide all captured images to the model or vendors. Instead, the photographer will make a final selection of images.
- The Model acknowledges that image selection and editing are part of the Photographer’s creative process and are not subject to prior approval. The Model consents to the use of the images by the Photographer and participating Vendors as outlined in this Agreement and agrees that no claims will be brought in relation to the use of the images, except in cases of wilful misconduct or gross negligence.
